What is personal data<\/strong><\/p>\n\n

According to the GDPR, personal data is defined as: \u201cany information relating to an identified or identifiable natural person; an identifiable person is one who can be identified, directly or indirectly, by reference in particular to an identifier such as a name, an identification number, location data, an online identifier, or to one or more characteristic features of his or her physical, physiological, genetic, mental, economic, cultural or social identity.\u201d<\/p>\n\n

Purpose of personal data processing<\/strong><\/p>\n\n

The Data Controller collects and processes your data for the conclusion and execution of the contract having as its object the services offered by ITALCOIL SRL, that is, for purposes strictly related and instrumental to the management of the contractual relationship (administrative and accounting activities, customer care, claims management and debt collection) and the provision of services, from time to time, requested.<\/p>\n\n

Specifically, for these purposes, ITALCOIL SRL collects and processes the following data:<\/p>\n\n

– personal and identifying data (first name, last name, date and place of birth, social security number, gender);– the residential address, telephone number and e-mail address;– the bank account details for the relevant debit;– in general, any other data and information necessary for the conclusion and execution of the contract.<\/p>\n\n

Subject to your express and specific consent, the Data Controller may then process your data for profiling purposes, to allow the processing and completion of statistical and market studies and research, to allow the creation\/definition of your profile and\/or personality, to analyze your tastes, preferences, habits, needs and\/or consumption choices so as to be able to offer you products and services more in line with your needs and a whole series of promotions. In particular, as part of this activity, as well as for the marketing purposes described below, ITALCOIL SRL uses a CRM system – implemented and provided by Facebook – within which the data flows. <\/p>\n\n

The Data Controller may process your data to send you communications of a commercial nature and\/or for promotional initiatives for the purpose of the direct offer of its own products and\/or services similar to those you have already subscribed to. ITALCOIL SRL will carry out this activity in compliance with the principles of the GDPR and for the pursuit of its own legitimate interest; in any case, you may object at any time to the receipt of such communications by writing to the Data Controller at the e-mail address or by contacting the DPO at the contact details indicated in the previous paragraph. <\/p>\n\n

In addition, with your express and specific consent, the Controller may process your data for promotional initiatives (present and future) of a commercial nature, sending advertising material, carrying out market research, direct sales. The sending of commercial communications may take place through the use of traditional systems (paper mail, operator calls) and automated communication systems (SMS, e-mail, chatbot). <\/p>\n\n

Finally, on the basis of its legitimate interest, ITALCOIL SRL will process your data in order to conduct statistical market research and to assess your degree of satisfaction in relation to the services offered by the Owner.<\/p>\n\n

Disclosure of personal data<\/strong><\/p>\n\n

ITALCOIL SRL may communicate some of your data to the subjects it uses to carry out activities necessary to achieve the purposes indicated and described in the previous paragraph. These include companies that, on the basis of a service contract, have undertaken to support the Data Controller in carrying out profiling, web advertising and more generally marketing activities. <\/p>\n\n

In addition, the data referable to you may be communicated to the companies that the Controller uses for the purpose of managing and maintaining the information systems on which the data referable to you are surveyed and stored as well as companies that carry out in favor of the Controller the services of printing, enveloping and mailing of documents (e.g., invoices).<\/p>\n\n

The subjects mentioned above who process your data on behalf of ITALCOIL SRL are specifically appointed as Data Processors by the Data Controller.<\/p>\n\n

The list of Data Processors can be obtained by contacting the DPO at the contact details given in the previous paragraph.<\/p>\n\n

Finally, the Data Controller may communicate your data to parties to whom the communication is due by virtue of legal obligations, to attorneys specifically identified by the Data Controller, to Public Administrations as well as to companies offering postal and logistics services (i.e., Poste Italiane).<\/p>\n\n

These entities carry out their respective processing activities as independent data controllers.<\/p>\n\n

Transfer of personal data<\/strong><\/p>\n\n

ITALCOIL SRL does not normally transfer your data outside the European Union.<\/p>\n\n

In the event that it becomes necessary to transfer data referring to you to third countries, the Data Controller shall ensure that the recipient, specifically appointed as Data Processor, complies with the provisions set forth in the GDPR including the rules specifically dictated for the transfer of personal data to third countries. In particular, ITALCOIL SRL. ensures that such transfers take place on the basis of an adequacy decision or the signature by the Data Processor of the standard contractual clauses approved by the European Commission. <\/p>\n\n

The actual transfer of personal data to third countries and related more information about the same can be requested by writing to the Holder at e-mail.<\/p>\n\n

Retention of personal data<\/strong><\/p>\n\n

The data referring to you will be processed by ITALCOIL SRL only for the time necessary for the purposes mentioned above.<\/p>\n\n

In particular, we report below the main periods of use and retention of your data with reference to the different processing purposes:<\/p>\n\n

for the purposes of the execution of the contract to which you are a party, the data referring to you will be processed by ITALCOIL SRL for the entire duration of the contract and until there are obligations or fulfilments related to the execution of the contract, and will be kept for a period of 11 years after the termination of the contractual relationship exclusively for purposes related to the fulfillment of legal obligations or the defense of ITALCOIL SRL’s rights; with reference to processing for marketing purposes, carried out on the basis of a legitimate interest of the Data Controller, i.e. your consent, your data will be processed for the entire duration of the contract and as long as there are obligations or obligations related to the execution of the contract, unless you object to the processing or any revocation of the consent you have given; your data will be processed for profiling purposes until you decide to revoke your consent and\/or obtain the termination of the processing. In any case, profiling activities will only take into consideration data related to the last 12 months. Rights of the data subject to data processing. <\/p>\n\n

During the period in which ITALCOIL SRL holds or processes your data, you, as a data subject, may at any time exercise the following rights:<\/p>\n\n

Right of access<\/strong>– You have the right to obtain confirmation regarding the existence or otherwise of processing concerning your data as well as the right to receive any information related to the same processing;Right to rectification– You have the right to have your data in our possession corrected if it is incomplete or inaccurate; Right to erasure (so-called \u201cright to be forgotten\u201d)– under certain circumstances, you have the right to obtain the deletion of your data within our records if it is not relevant to the continuation of the contractual relationship or required by legal obligation;Right to restriction of processing – upon the occurrence of certain conditions, you have the right to obtain the restriction of processing concerning your data if it is irrelevant to the continuation of the contractual relationship or necessary due to legal obligation; Right to portability– You have the right to have your data in our possession transferred to a different data controller;Right of opposition– You have the right to object, at any time on grounds relating to your particular situation, to the processing of data relating to you based on the lawful condition of legitimate interest or the performance of a task carried out in the public interest or in the exercise of official authority, including profiling, unless there are legitimate grounds for the Controller to continue the processing that override the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of a legal claim;Right to withdraw consent– You have the right to revoke your consent to the processing of your data at any time, without prejudice to the lawfulness of the processing based on the consent before revocation;<\/p>\n\n

Right to file a complaint with the Supervisory Authority<\/strong>– In the event ITALCOIL SRL refuses to comply with your requests for access, the reasons for such refusal will be provided. If applicable, you have the right to propose a complaint as described in the following paragraph. <\/p>\n\n

The above rights may be exercised against the Controller by writing to the e-mail address or by contacting the DPO at the contact details given in the previous paragraph.<\/p>\n\n

The exercise of your rights as a data subject is free of charge under Article 12, GDPR.<\/p>\n\n

However, in the case of requests that are manifestly unfounded or excessive, including because they are repetitive, the Owner may charge you a reasonable fee in light of the administrative costs incurred in handling your request, or deny satisfaction of your request.<\/p>\n\n

Complaint<\/strong><\/p>\n\n
